Election petition Tribunal sitting in Abakaliki, Ebonyi state capital on Monday, affirmed Governor David Umahi’s victory during the March 9 governorship election in Ebonyi state.

Chief Ajah Agha of the Peoples Democrati\nc Movement (PDM), had dragged Umahi to the Tribunal after the election over unlawful exclusion of his name from INEC ballot paper, accusing PDP and its candidate of being behind it.

The sitting which took place at the state High Court premises was presided over by Justice A.B Abdulkarem.

In his judgement, justice Abdulkarem dismissed the petition for lack of merit, stating: “PDM did not submit the name of their candidate to INEC when they were supposed to do so”

“Your party sent the name of your candidate three days after closure of submission, according to findings”

“Also your party did not organize primaries as to produce a candidate according to INECs guideline, therefore your petition lacks merit.

Reacting to the judgment, the state deputy Governor Barr. Kelechi Igwe, who led other Exco members to the Tribunal, said the court is not a chessboard and has proven that no one can deceive it.

The lead counsel to the respondent, Author Obi Okafor, SAN, noted that the lawyers were given opportunity to present their cases and no one would complain of not given a fair hearing.

He said PDM and its candidate failed to prove that he was validly omitted as such, the case was struck out.
